Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and PostureFix ("PostureFix", "we", "our", or "us") and govern your use of the PostureFix mobile application and any related services (collectively, the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (16 in the European Economic Area) to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on a compatible Apple device that you own or control, solely for your personal, non-commercial use.

You may not (and may not permit anyone else to): (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent that applicable law expressly permits despite this limitation; (c) rent, lease, sell, sublicense, or otherwise transfer rights to the App; (d) remove or alter any proprietary notices; or (e) use the App in any way that violates law or these Terms.

3. Subscriptions and one-time purchases

The App offers in-app purchases through Apple's In-App Purchase system. Available products may include auto-renewing subscriptions (e.g. Monthly, Yearly) and one-time non-consumable purchases (e.g. Lifetime Access).

Auto-renewing subscriptions. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID will be charged the renewal price at confirmation of purchase and at the start of each new billing period.
Pricing. Current prices are displayed inside the App on the subscription screen. Prices may vary by region, applicable taxes, and currency.
Managing or canceling. You can manage or cancel subscriptions at any time in your Apple ID settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period.
Free trials and introductory offers. If a free trial or introductory offer is provided, the unused portion is forfeited if you purchase a subscription before the trial ends, where applicable by law.
Refunds. Refunds for purchases made through Apple are handled by Apple in accordance with its refund policy. Contact Apple Support to request a refund.
Lifetime products. "Lifetime" means for the operational lifetime of the App and your active Apple ID account. We make no guarantee that the App will be available indefinitely.

4. Acceptable use

You agree not to: (a) use the App for any illegal purpose; (b) attempt to interfere with or disrupt the App or its servers; (c) attempt to bypass our subscription or payment systems; (d) use automated systems to access the App; or (e) misrepresent your identity.

5. User-generated content

The App does not currently accept user-generated content uploads. All exercise demonstrations, copy, and analysis logic are owned by us or licensed from third parties.

6. Health and fitness disclaimer

PostureFix is a general wellness and fitness app. It is not a medical device. The App does not diagnose, treat, cure, or prevent any disease or medical condition. Posture analysis results, recommendations, and exercises are provided for general informational and motivational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any new exercise program, especially if you have an existing injury, chronic condition, are pregnant, or have any concerns about your physical health. If you experience pain or discomfort during any exercise, stop immediately and seek medical advice. You use the App at your own risk.

7. Intellectual property

The App, including all software, designs, logos, trademarks, text, graphics, and content, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not transfer any ownership rights to you. All rights not expressly granted are reserved.

8. Third-party content and services

The App embeds video demonstrations from YouTube, served by Google LLC, and integrates services from Apple, RevenueCat, and Supabase. Your use of any third-party content or service is subject to that party's own terms and privacy policy. We are not responsible for third-party content or services.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the App will be error-free, that defects will be corrected, or that the App will meet your specific requirements.

10. Limitation of liability

To the fullest extent permitted by applicable law, PostureFix and its officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation damages for loss of profits, goodwill, data, or other intangible losses — arising out of or related to your use of (or inability to use) the App. Our total liability for any claim arising out of or related to the App is limited to the greater of (a) the amount you paid us for the App in the 12 months preceding the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless PostureFix and its affiliates from any claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your use or misuse of the App, (b) your violation of these Terms, or (c) your violation of any third-party right.

12. Termination

You can stop using the App at any time. We may suspend or terminate your access if you violate these Terms or use the App in a way that creates risk for us or other users. The disclaimer, limitation-of-liability, indemnification, and dispute-resolution provisions survive termination.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above and, where appropriate, by notice in the App. Your continued use of the App after the changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law principles. Disputes arising out of or related to the App or these Terms will be resolved by the competent courts of Poland, except where mandatory consumer-protection law in your country of residence (including, where applicable, the laws of the European Union) requires otherwise. If you are a consumer residing in the European Union, nothing in these Terms deprives you of the protections of the law of your country of habitual residence.

15. Apple-specific provisions

The following terms apply when you use the App on an Apple iOS device:

These Terms are between you and PostureFix only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
The license granted in Section 2 is limited to use of the App on Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide any maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the App, including (i) product liability claims, (ii) claims that the App fails to conform to legal or regulatory requirements, and (iii) claims arising under consumer-protection or similar legislation.
We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the App.
You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
